Planning Application - (17/01714/RG3) - Futurist Theatre and Land to the rear Futurist Buildings, Foreshore Road, Scarborough pdf icon PDF 357 KB

To consider:-

     (i)    a planning application for the proposed demolition of existing Futurist Buildings comprising the former Futurist Theatre, Mermaid Pub, Chip Shop and Shop Units. Regrading of slope on site, and removal of existing King Street Car Park behind existing Futurist Buildings.  Erection of retaining walls at bottom of slope to form plateau off Foreshore Road. Hard and soft landscaping reinstatement works for Mr Chris Bourne (Scarborough Borough Council); and

     (ii)   a report of the Planning Services Manager (Reference 17/235) attached.

Minutes:

The Committee considered:-

(i)a planning application for the proposed demolition of existing Futurist Buildings comprising the former Futurist Theatre, Mermaid Pub, Chip Shop and Shop Units. Regrading of slope on site, and removal of existing King Street Car Park behind existing Futurist Buildings. Erection of retaining walls at bottom of slope to form plateau off Foreshore Road. Hard and soft landscaping reinstatement works for Mr Chris Bourne (Scarborough Borough Council); and

(ii)  a report of the Planning Services Manager (Reference 17/235).

Updating the report the Planning Officer advised that the Environmental Health Officer had no objections subject to the recommendations in the report. Additional measures proposed by the applicant to minimise noise from the crushing of materials were reported and the officer noted a condition relating to this is already recommended. The Tree Officer has confirmed no objection regarding impact on a sycamore in St Nicholas Gardens. Details of further objections from the Theatres Trust and the Cinema Theatres Association were reported, in addition to two new objections from members of the public. The officer highlighted the key issues in the report and emphasised that when assessing viability greatest weight was attached to the most recent professional assessments and marketing. Paragraph 8.3 of the report was also corrected, which should refer to Local Plan Policy DEC5 and not Policy DEC3.

In accordance with the Council’s Public Speaking Scheme Shirley Sheppard spoke against the scheme. Councillor Janet Jefferson (Ward Councillor) spoke against the scheme, in particular concerns on the effect on residents and businesses in the vicinity.

Members commented on the report and asked questions. In response the Planning Officer advised that in the event no development came forward there would be landscaping after two years; if there were to be an application for re-development in the interim, then officers would look to incorporate landscaping within the scheme. Clarity was provided regarding the number of car park spaces on King Street car park, 67 is a conservative estimate provided by parking services; these include 22 spaces that could be retained depending on visibility.  A representative of the Highway Authority confirmed that the 22 spaces would require additional permission to come back in to use because of access issues.  It was confirmed that insurance in the event of slope failure was not a planning matter, but that Scarborough Borough Council as land owner is exploring full insurance coverage. 

A representative from Alan Wood & Partners (independent advice) provided more detail on the drainage weep-hole system in response to a question.

RESOLVED that permission be GRANTED subject to the conditions set out in the report and prior referral of the application to the National Planning Casework Unit to determine whether the decision should be made by the Secretary of State.

     (i)    a planning application for outline permission for residential development served by new access from Ridge Lane, for Miss Hermoine Gayton; and

     (ii)   a report of the Planning Services Manager (Reference 17/213)

The Committee considered:-

     (i)   a planning application for outline permission for residential development served by new access from Ridge Lane, for Miss Hermione Gayton; and

           (ii)  a report of the Planning Services Manager (Reference 17/213).

Consideration of this application was deferred at the previous meeting to allow members to undertake a site visit which took place on 18 October 2017. 

The Planning Officer advised that since the report was drafted the Council’s Ecologist and Biodiversity Officer has reviewed the conditions and advises that following some further understanding about the nature of the application site, the condition for a Reptile Survey may be waived, noting that the ecological survey was carried out in winter and a presumption made that the habitat in the warm months when reptiles are active would be the same.  However, the field is mown and periodically used for camping in the summer months and as such the potential for reptiles on the site is minimal.

The Planning Officer advised that there was an amendment to Condition 11 to delete part (iv).

In accordance with the Council’s Public Speaking Scheme Felicity Prior (on behalf of the Applicant) spoke for the scheme and Amanda Coates spoke against the scheme.

RESOLVED that permission be GRANTED for outlinine planning permission subject to the signing of the Section 106 Agreement relating to contributions to affordable housing and off-site open space and the conditions as set out in the report with an amendment to Condition 11 to delete part (iv).
