Councillor Cluer declared a personal interest in agenda item 6, Planning Application - (18/00615/RG3 and 18/00616/LB) - Dean Road Depot, Dean Road, Scarborough, since she had been a member of the scrutiny task group which had examined the future of the Parks Nursery service and Dean Road Depot.

 

Councillor Chance declared a personal interest in agenda item 11, Planning Application - (18/00823/HS) - 13 Heather Drive, Whitby, since he was acquainted with the applicant.

Minutes:

In respect of Minute 5, the Planning Services Manager advised that the reason recorded for refusal of the outline planning application for residential development on land adjacent to 38 Limestone Road, Burniston, was now in effect redundant, since the applicant had made an appeal because of non-determination of the application.  Members confirmed that the reason cited for refusal of the application was as minuted.

RESOLVED that the minutes of the meeting held on 7 June 2018 be approved as a correct record and signed by the Chairman.

Updating the report, the planning officer advised that slightly amended plans had been submitted since the report was published, removing six car parking space adjacent to the two properties closest to the car park and so retaining additional grass verge.  Further, it was now proposed to extend the acoustic fencing on the boundary with residential properties to lessen possible noise impacts.  This would be covered by condition.  In respect of the consultation section of the report, the planning officer advised that the Lead Flood Authority had raised no objections subject to conditions relating to the drainage of the site.  An additional ten objections and one letter of support had been submitted which reiterated points already outlined in paragraphs 4.6 and 4.7 of the report.  The application was recommended for approval subject to the conditions set out in the report, the prior completion of a s106 agreement to secure payment for a Traffic Regulation Order, and additional conditions namely the drainage conditions recommended by the Lead Flood Authority, details of fencing in the hotel vicinity to be approved first, and extending the existing acoustic fencing on the northern boundary.  In accordance with the Council’s Public Speaking Scheme, the agent, Mr J Stentiford spoke in support of the application, and Mr K Lavender spoke against.  Local Councillor Vanda Inman also spoke against the application making a number of criticisms including: overbearing scale of building, unsympathetic use of materials, poor design, configuration of car park, no electric charging points, increased traffic congestion, uncertainty around validity of Environmental Impact Assessment, no community engagement by developer, no crime prevention plans, light pollution, impact on neighbours of hotel’s hours of operation, and therefore lack of compliance with local and national planning policy in addition to worrying divergence from the original vision for the Sands and North Bay.  Members of the committee then commented and asked questions about the application.  Some were also concerned about the scale and design of the building, the impact of noise and light on neighbours and questioned the sustainability of a 105 bedroom hotel during the winter months in its location outside the town centre.  Others spoke in favour, noting how dramatically tourism had changed in the last 30 years, that 105 was a modest number of car users, and the positive economic impact of the development.  In respect of disabled access, the planning officer noted the ground floor rooms with large dimensions in the plans and that a condition was proposed to ensure easy wheelchair access.  A motion to refuse the application was put to the vote and lost.  This was followed by a motion to approve the application which was carried.

Minutes:

Updating the report, the planning officer advised that the Highway Authority had recommended a number of conditions which the planning officer suggested be added as informatives to the consent.  The planning officer sought delegated authority to identify these informatives.  The Highway Authority had also suggested that a contribution of £18k be made for improvements to the roundabout and junction on Columbus Ravine.  The planning officer commented that such a contribution was not appropriate given the significant reduction in staff and vehicles operating out of the depot since the 2000s.  Currently, there were some 100 staff based at the depot and the proposals in the report would only increase the number to 140.  In reply to Members’ questions and comments, the planning officer advised that projected vehicular movements in and out of the depot would be staggered and not considered hazardous; the proposals to improve pedestrian access took into account use of the site by members of the public; and she was content to make the provision of swift boxes fitted to the north elevation of suitable buildings a condition rather than an informative.

RESOLVED that planning permission and listed building consent be GRANTED subject to delegated powers to finalise:

(i)            the planning conditions listed in the report with the addition of the installation of swift boxes to the north elevation of buildings and informatives relating to the comments of the Highway Authority; and

(ii)          the listed building conditions outlined in the report.

The committee considered:-

(i)            a report seeking confirmation of a tree preservation order for one lime tree; and

In accordance with the Council’s Public Speaking Scheme, Ms Y Hazlewood spoke against the application.  One Member spoke in support of the officers’ recommendation whilst another commented with reference to paragraphs 5.2 and 5.3 of the report that he did not see the amenity value of the tree in question nor the wider public benefit which would accrue in making a Tree Preservation Order.  The motion to confirm the Tree Preservation Order was put to the vote and lost.  The motion not to confirm the Tree Preservation Order was then put to the vote and carried. 

RESOLVED that the Tree Preservation Order NOT BE CONFIRMED for the following reason:

Making a Tree Preservation Order is not justified on the grounds of the amenity value of the tree in question nor of the wider public benefit which would accrue in making such an order.

Updating the report, the planning officer advised that in respect of paragraph 7.4 of the report, the maximum number of children using the nursery at any one time had already been reduced to six.  Further, the fence separating the area of garden for use in conjunction with the child minding business from the area used in conjunction with the dwelling had been taken down since the children were now taken off-site more instead of playing in the rear garden.  Commenting on the report, Members felt that the condition limiting the consent initially to one year was unnecessarily harsh given the investment the applicant was putting in the business.

RESOLVED that permission be GRANTED subject to the conditions set out in the report with the removal of condition 2 limiting the duration of the consent initially to 5 July 2019.
