Referring to a plan of the property in the report, on which a floor plan marked five bedrooms, one Member sought confirmation that the application was indeed for four bedrooms. The Planning Officer confirmed that the numbering was an error, and that the application was for four bedrooms.

 

RESOLVED, that permission be GRANTED subject to the conditions set out in the report.

To consider an outline planning application for residential development with all matters reserved except for access (indicative yield of 42 dwellings) for Ava Holdings (ref. 20/150 attached).

The Committee considered:

i. an application for outline permission for a residential development, with all matters reserved except for access, at land to the east of Centenary Way Camping & Caravan Park, Filey.

The Planning Officer, when giving his presentation to the Committee, referred to twelve key issues for consideration in respect of this application. The Officer informed the Committee that each of these had been covered, in some depth, within the report, but that there were five particular areas that warranted further attentions. One; in principle this site has been allocated for housing development in the Local Plan. Two; while recognising the comments made by neighbours and the Town Council, the Highways Authority has no objections to this plan. Three; the issue of Flood Risk, and the plan to discharge surface water to the existing new sewer, that runs from the Mill Meadows site. Yorkshire Water had informed Planning Services that the capacity exists to handle this. No objection has been received from the LLFA. Four; the issue of amenity regarding the railway line running adjacent to the site. While there is no immediately obvious noise issue at the site Environmental Health Officers have requested that reserve matters be brought forward, in line with a noise impact assessment. Five; the issue of health; The NHS Clinical Commissioning group for the area has requested £16,835.00 to be secured by a S106 agreement, to offset the costs of providing primary care for new residents in the locality. The applicant has agreed to this sum. Following the Officer’s presentation, the Planning Services Manager read a statement on behalf of Dan Mitchell, an agent from Barton Willmore, writing in support of the application. Following this statement the Chair invited Filey Town Councillor, Councillor Kevin Wilkie, to speak against the application. Questioning the application, Members highlighted concerns regarding pedestrian use of the railway crossing in the vicinity of the application. The Planning Officer responded to this by explaining that Network Rail have not objected to the application, and have simply made observations. The Committee also sought clarity on entry to the site, specifically the smaller access route to the site. The Officer suggested that this particular route would be limited to pedestrians, other than emergency vehicles. Following a number of concerns raised by Members in relation to the site the decision was taken to defer any decision on the site, until after a site visit had been made by Members.

 

RESOLVED that the item be DEFERRED, pending a site visit by members of the Committee.

To consider a planning application for the demolition of existing building and the erection of six self-contained flats (C3), hostel (sui generis) and car parking at ground floor level for FG Normandale (Scarborough) Ltd. (ref. 20/151 attached).

Adding to the report, the Planning Officer verbally reported further comments on the scheme, received on 12/08/2020, from a local resident. Generally, the Committee were pleased with the design and scale of the proposed building, and there was some consensus that the application would be of benefit to that area of Scarborough.

 

RESOLVED that permission be GRANTED subject to the conditions set out in the report.

Expanding on the content of the report the Planning Officer explained to the Committee that the developer had a clear financial motivation to complete the affordable housing on the site before being able to release the last three open market dwellings.

 

RESOLVED that the variation to the S106 legal agreement be AGREED.

The Planning Services Manager advised the Committee of a late a representation from a local community group, raising a number of issues regarding the application, and that the Officer recommendation was now one of deferral.

 

RESOLVED that the application be DEFERRED for consideration at a future meeting.

Following the Officer’s presentation to the Committee it was agreed by Members that the work was essential. It was hoped that the necessary work could make use of the quiet period the Spa was currently facing; due to the current situation with regards to COVID-19.

 

RESOLVED that both listed building and planning permission be GRANTED.

Following the officer presentation the Chair invited Councillor Liz Colling to address the Committee, in her capacity as the Cabinet Portfolio Holder for Planning. Following on from the Councillor’s comments the Planning Services Manager addressed the Committee. Referring to the envisaged changes to local government in the near future (devolution within North Yorkshire) the PSM stressed the need for a robust local plan with or without these changes occurring. The Committee stressed the need to make the public consultation of the report as easy as practicable, and raised the importance of engaging with town and parish councillors, as well as the public at large. The Planning Officer confirmed an intention to make numerous communications with various interested stakeholders, in response to this, as well as using social media to broaden the ability to engage with local people, and highlighting the fact that all communications would be welcomed. The Committee were pleased to see references to climate change in the report, and to street trees, but also highlighted issues with building houses that are purchased as buy to let and holiday/second homes. Responding to this the Planning Officer stressed that attempts to deal with second home ownership has seen limited success.

 

RESOLVED that the documents have been APPROVED for publication for consultation.

Response to the Consultation by BT on the Removal of Specified Phone Kiosks Across the Borough pdf icon PDF 825 KB

The Planning Officer sought delegated authority to deal with future instances of BT seeking to remove telephone boxes across the Borough for a period of three years. The Members regretted the fact that this issue had arisen again, so soon after having previously come before Committee. Offering some anecdotal evidence Members confirmed that telephone signal remained poor in areas where BT are seeking to remove kiosks. The Committee also suggested exploring other means with which to deal with this reoccurring issue; namely taking the issue to the Borough’s two MPs.

 

RESOLVED that Planning Officers respond to BT’s consultation, in line with the recommendations within the report, and write to the Borough’s two MPs to assist in the matter of this report.
