Councillor Amanda Robinson, declared a Personal and Prejudicial interest in agenda item 5, Planning Application (14/01020/FL) - 55 Holbeck Hill, Scarborough, since she knew the applicant as she was a close neighbour.

 

All Members present declared a general interest in agenda item 6, Planning Application (14/01038/RG4) - Slipway, Sandside, Scarborough, agenda item 7, Planning Application (14/01050/RG4) - South Bay Beach, Foreshore Road, Scarborough and agenda item 8, Planning Application (13/00956/COND) - Land to North of Eastfield, Eastfield, since Scarborough Borough Council owned the land.

 

Councillor Mrs Dorothy Clegg, declared a Personal interest in agenda item 9, Planning Application (14/01071/FL) - 1 Spital Bridge, Whitby, since Danielle Kipling, her partner and two children, are tenants of Mr W Wilson who owns the two houses on Green Lane.  Danielle Kipling is a part-time employee of Whitby Glass Ltd, recently returned from maternity leave.  Councillor Mrs Clegg is a Director of Whitby Glass Ltd.

The Committee considered a report of the Director of Service Delivery (Reference 14/155) regarding the draft Green Space Supplementary Planning Document.  The document had been considered by Cabinet and approved for public consultation with the proviso that any amendments made by this Committee be incorporated into the draft prior to circulation.  In the event, no amendments were made.

RESOLVED that:-

(i)         the report be received and;

(ii)        the Draft Green Space Supplementary Planning Document be published for consultation

Members’ reasons: The Committee agreed to the document being circulated for public consultation because it would come back to Committee for consideration following public consultation.

Updating the report the Planning Officer advised the addition of an Informative at Condition 5 that all machinery should be property silenced and comply with BS5228 and adequate measures should be taken to suppress dust.  A commuted sum of £9,996 is required.  The main comments of a letter submitted by Mr N Brownbridge, a neighbour, were read out to the meeting.  In accordance with the Council’s Public Speaking Scheme, Mr C Kendall (Agent) spoke in favour of the scheme and Mr P Heselton (Neighbour) spoke against the scheme.  The Ward Councillor, Mrs P Marsden, spoke against the scheme.

RESOLVED that permission be GRANTED subject to the completion of the draft s106 Agreement covering the obligations outlined in paragraph 6.19 of the report, the addition of wording in Condition 3 regarding surface water drainage, the addition of an Informative at Condition 5 referred to above and the Conditions as set out in the report.

 

(In accordance with her declaration in Minute 1, Councillor Mrs A Robinson left the meeting prior to the debate and determination of this item.)

Updating the report the Planning Officer advised that Ward Members had asked that the development be reviewed after the first season, but this was considered to be a matter for Estates, and the lease had been drafted accordingly.  It was felt in planning terms that a five year permission should be granted to allow a review, possibly alongside a review of the Beach Policy. 

RESOLVED that permission be GRANTED subject to an amendment to Condition 8 to include details of the design of the fence, the addition of Condition regarding the screening around the base of the platform and the Conditions as set out in the report.

i.          a planning application for Discharge of Condition 47 relating to application reference 11/01914/OL for an outline application for up to 1,350 dwellings together with ancillary facilities including detailed design for a link road with bridge to provide a connection between A64 and A165, for K2 Regeneration LLP; and

i.        a planning application for Discharge of Condition 47 relating to application reference 11/01914/OL for an outline application for up to 1,350 dwellings together with ancillary facilities including detailed design for a link road with bridge to provide a connection between A64 and A165, for K2 Regeneration LLP; and

ii.       a report by the Planning Services Manager (reference 14/262).

Updating the report the Planning Officer advised that the Street Summaries were to be amended in terms of materials following input from NYCC Highways, and that delegated authority be given to officers to agree these subject to the approval of the Chair.  When the Design Code had been brought to the meeting last August it had been suggested that there be a timetable for review of this document, but the Planning Officer recommended that the Code be reviewed as and when necessary in consultation with the Chair and Vice-Chair.  Members debated their concerns about trees, grass and subsequent maintenance, the design of the development to encourage a 20 mph speed limit and the possible planting of fruit trees.

RESOLVED that the provision of Condition 47 of Planning Permission 11/01914/OL be DISCHARGED for the reason set out in the report.

i.          a planning application for Demolition of existing building and two industrial buildings to rear of site and construction of a new building on the site frontage to comprise 2 x 4 bed town houses and construction of 1 x 2 bed, 2 x 3 bed and 1 x 4 bed terraced houses to the rear plus 10 car parking spaces and associated external works for Open Aspect Property Consultants Ltd (Mr Ian Storer); and

ii.         a report by the Planning Services Manager (reference 14/208) attached.

Updating the report the Planning Officer recommended Condition 9 be amended to provide details of all boundary treatments at an appropriate point in the construction process subject to the wording being agreed with the Chair and Vice-Chair. Also that Condition 16 be amended so that permitted development rights be removed in relation to boundary treatments.

RESOLVED that permission be GRANTED subject to the completion of the draft S106 Agreement as referred to in paragraph 7.1 of the report, the amendments to Conditions 8 and 16 as outlined above and the Conditions as set out in the report.

The Committee considered a report of the Planning Services Manager (Reference 14/252) regarding Current Planning Appeals lodged against decisions of the Borough Council.  The Planning Officer gave background information on appeal reference APAA/00010/14, Tesco Express, 83-85 Burniston Road, Newby, Scarborough.

RESOLVED that:-

(i)      the report be received; and

(ii)     progress with current appeals and recent appeal decisions be noted.
