Minutes:

Councillor Amanda Robinson, declared a Personal and Prejudicial interest in agenda item 4, Planning Application (14/00528/FL) - Proudfoot Supermarket, 401 Scalby Road, Newby since her husband was employed as a Director of a company who was a supplier to supermarkets.

Councillor Brian Francis Watson, declared a Personal and Prejudicial interest in agenda item 4, Planning Application (14/00528/FL) - Proudfoot Supermarket, 401 Scalby Road, Newby since he lived in Coldyhill Lane and was disturbed by the lorries turning round in Coldyhill Crescent.

Councillor Dilys Vine Cluer, declared a Personal interest in agenda item 8, Planning Application (14/01428/RG3) - Manor Road Nurseries, Manor Road, Scarborough since she was the Chair of the Sustainability Working Group and approved the project of the PV panels, but would decide on this application with an open mind and on Planning grounds.

RESOLVED that permission be GRANTED subject to the conditions set out in the report and a condition that the boundary wall remain in situ to protect the amenity of the next door neighbour, if the wall is found to be in the ownership of the applicant.

Updating the report the Planning Officer advised that the Highway Authority recommended two conditions regarding the road and footway layout and that no occupation of the properties should take place until the road had been surfaced.  The Countryside Officer had no objection to the loss of the sycamore tree and recommended that a suitable replacement be planted.  There had been no reply from the Council’s Drainage Engineers but Yorkshire Water confirmed that foul and surface water drainage details were satisfactory.  The Building Inspector advised that he would liaise with the developer in respect of Japanese Knotweed.

RESOLVED that permission be GRANTED subject to the conditions as set out in the report, a condition that the sycamore tree be removed and replaced with a suitable tree and that reference to demolition works in Condition 6 be deleted.

The Committee considered:

i.                 a planning application for change of use from A1 (retail) to A3 (restaurant/cafe) and A5 (takeaway), alterations to shopfront and installation of extraction equipment on flat roof to rear, for Marsdens Caterers Ltd; and

ii.                a report by the Planning Services Manager (reference 14/283).

Updating the report the Planning Officer advised that no application had been received in respect of signage.  The Highway Authority had no objection to the vehicles to be used to service the premises.  Planning Officers had been consulted in respect of vacant units and a breakdown was provided to the meeting.  Further clarification had been sought from Environmental Services who confirmed that there was no minimum height regulations in respect of the extraction system.  The ionisation in the extraction system provided a high level of control in respect of odour.  The cooler units had been re-sited and will have acoustic housing.  Environmental Services advised that a reduction of between 12 to 18 decibels should be achievable above background levels. The Planning Officer recommended that the operator should seek to achieve a reduction of between 16-18 decibels to ensure on-going compliance.

In accordance with the Council’s Public Speaking Scheme Ms L Davison (Agent) spoke in favour of the scheme and Mr Mort (Neighbour) spoke against the scheme.

Members raised concerns regarding odour and noise control and asked that Environmental Services regularly monitor these.  In respect of odour control Environmental Services be asked to review this in light of the report supplied being for a Drive Through restaurant.  The Planning Officer confirmed that once the report had been reviewed and amended as necessary to ensure it was satisfactory to Environmental Services, Officers would confirm matters with the Chair and Vice Chair and seek their approval before issuing the decision notice.

RESOLVED that permission be GRANTED subject to the conditions as set out in the report and conditions regarding odour control, noise mitigation, party wall and management of rubbish and staff not to be allowed on the roof.
