Minutes

To approve as a correct record and sign the Minutes of the meeting held on               2011.  (Minutes to be attached).

RESOLVED that this item be DEFERRED as the Minutes of the meeting held on 14 August 2014 were unavailable at the meeting.

The Planning Services Manager updated the meeting on Minute 5 of the meeting held on 12 June 2014 regarding Land at High Mill Farm, Station Road, Scalby.  The legal agreement had not been signed, therefore planning permission had not yet been granted.   Planning Officers advised that Condition 7 relating to the foul and surface water drainage scheme approved under Reserved Matters Consent reference 11/02265/RM would be amended in consultation with the Chairman to require new drainage details rather than rely on the details agreed in 2011.  This was in order to ensure consistency with other phases of the High Mill Farm.

The Committee considered:-

i.        a planning application for demolition of existing transit shed workshop, erection of new workshop, installation of dry dock and new vehicular access, for Parkol Marine Engineering Ltd (Mrs S Atkinson); and

ii.        a report by the Planning Services Manager (reference 14/209).

In accordance with the Council’s Public Speaking Scheme, Mrs S Atkinson (Applicant) spoke in favour of the application.

RESOLVED that the application be APPROVED subject to the conditions as set out in the report and an additional condition that the external roller shutter doors be kept closed except for access.

i.        a planning application for demolition of offices and industrial buildings and erection of 45 residential dwellings including 7 affordable houses, creation of retail shop (A1), open space and associated infrastructure for Proptrade Ltd (Mr Dean Golding; and

ii         a report of the Planning Services Manager (reference 14/307).

Updating the report the Planning Officer recommended that because of the outstanding issues relating to viability, education payments and affordable housing that this application be deferred at the request of the applicants until the next meeting in October.

RESOLVED that this application be DEFERRED to allow time to deal with the aforementioned outstanding issues.

i.        a planning application for discharge of condition relating to 06/01737/FL - Proposed rugby pitches and associated clubhouse including car parking, stand, floodlights, access and landscaping, for Scarborough RUFC (Mr Graeme Jeffrey); and

ii.        a report of the Planning Services Manager (reference 14/311.

Updating the report the Planning Officer advised that this application was not subject to the normal publicity requirements, however Newby & Scalby Parish Council had submitted an objection to the application as the Parish Council considered that to grant this discharge of Condition 42 would set a precedent.  The Planning Officer advised that he considered this application would not set a precedent as each application would be considered on its own merits.  If there were subsequent applications then members could consider any cumulative effect.  The Council’s Solicitor concurred with this advice.

RESOLVED that the application be APPROVED subject to the condition set out the report.

The Committee considered:-

Updating the report the Planning Officer reported that the Council’s Countryside and Ecology Officer had confirmed that as long as the recommendations of the ecological and arboricultural reports (dated September 2014) were adhered to he had no issues to raise.

RESOLVED that permission be GRANTED subject to the amended conditions set out in the report and the addition of the following conditions being included on the decision notice, in consultation with the Chairman:-

(a)      To require the use of protective fencing to the trees identified as being retained during construction works.

(b)      To require the development to be carried out in accordance with the recommendations of the ecological survey reports, which seek to incorporate features (mainly planting) of ecological value; and

that an informative be added:-

(c)      Condition 3 – landscaping scheme proposals to include native species in terms of tree planting and amenity grassland planting.
