4.

Planning Application (14/02327/DM) - Futurist Buildings, Foreshore Road, Scarborough pdf icon PDF 177 KB

i.                 planning application for the proposed demolition, for Scarborough Borough Council (Mr Chris Bourne); and

The Committee considered:-

i.        a planning application for the proposed demolition, for Scarborough Borough Council (Mr Chris Bourne); and

ii.       a report of the Planning Services Manager (reference 14/936).

Updating the report the planning officer advised that this is an application for Prior Approval of the method of demolition and proposed restoration of the site only.  These are the only issues which can be considered by the Council in its capacity as Local Planning Authority (LPA) when determining this application.  The planning officer explained the process of Prior Approval as set out in paragraphs 1.2 through to 1.6 of the report.  In accordance with the Council’s Public Speaking Scheme Ms P David spoke against the scheme as did Councillor Janet Jefferson the Ward Councillor.

RESOLVED that prior approval is required and a decision on the approval/refusal details of the proposed method of demolition and site restoration shall be made at a later Committee meeting.

Demolition of a toilet/shower block and replacement with a new toilet/shower block, for Bourne Leisure Limited; and

ii.                report by the Planning Services Manager (reference 14/419) attached.

The Committee considered:-

Updating the report the planning officer advised that the Coastal and Drainage Engineers had no objection. 

In accordance with the Council’s Public Speaking Scheme Mr N Thompson (Agent) spoke in favour of the scheme.

RESOLVED that, third party representations having been considered, permission be GRANTED, subject to the conditions set out in the report.

The Committee considered:-

Updating the report, the Planning Officer advised members that the Parish Council have objected to the proposal as they feel the current ones on site are enough.

In accordance with the Council’s Public Speaking Scheme Mr J Meaking (Interested party) spoke against the scheme as did Mrs L Thompson (Folkton and Flixton Parish Council).

RESOLVED that permission be GRANTED subject to the conditions set out in the report.

Members raised concerns re water safety in view of a nearby bridleway.  The Planning Officer suggested that condition number 5 be amended to make specific reference to safety measures.

RESOLVED that subject to details of the archaeological survey work being submitted and acceptable permission be GRANTED subject to the conditions set out in the report with an amendment to condition 5 to make specific reference to the inclusion of details of safety measures.

The Committee considered

i       a planning application for a residential development of 3 flats and 2 town houses, for Mr T Wellman; and

ii       a report by the Planning Services Manager (reference 14/934).

Updating the report the Planning Officer advised no objections had been raised during the consultation process and that Archaeological mitigation had been received.  An objection had been received from a nearby householder, who stated that the development would be noisy, the view would be spoilt and also block light into their own property.  While another had welcomed the proposal saying it would tidy up an area which at the moment is unsightly derelict land.

Members raised queries regarding matters set out in the report and considered the following matters:-

  • Parking area
  • Access for emergency vehicles
  • Concerns over development being near to a social club

RESOLVED that, third party representations having been considered, permission be GRANTED, subject to the conditions set out in the report.

 

10.

Update on Affordable Housing Provision Following Ministerial Announcement and Implications for the Affordable Housing Supplementary Planning Document pdf icon PDF 165 KB

Minutes:

The Committee considered a report of the Planning Services Manager (reference 14/429) regarding an update on affordable housing provision following ministerial announcement and implications for the affordable housing supplementary planning document.

The Planning Officer advised that the Ministerial Statement of 28 November 2014, had to be implemented immediately.  As we are a rule authority and we may determine to continue to negotiate financial contributions for affordable housing on small schemes within certain designated areas.  A small scheme is one between 5 and 10 units.  Further assessments since the report was finalised have shown that under the new rules only 4 sites in the last 10 years would have had to make a financial contribution.  As such it is not proposed to negotiate on any schemes of 10 units or less (unless they exceed the size threshold of 1000sqm).  For any schemes with more than 10 Units, negotiations for on-site provision will continue to take place.

RESOLVED that:-

i.        the report be received

ii         the Ministerial Statement of 28 November be noted, the contents of which are outlined in the report

iii        as a result of the further assessment of affordable housing contribution table provided to Members at the meeting be incorporated into the amended Affordable Housing SPD and used for the negotiation of affordable housing on residential schemes (subject to any further alterations as agreed by the Chair of P&D);

Members’ reasons: The proposed alterations in a Ministerial Statement dated 28 November 2014 are a material consideration in the determination of planning applications and should be reflected in up to date local guidance and policy. The Government’s online Planning Practice Guidance has been updated to reflect the amendment and the Planning Inspectorate and the Department for Communities and Local Government have confirmed that this amendment to planning policy should be implemented immediately.

The Committee considered a report of the Planning Services Manager (Reference 14/335) regarding information on current planning appeals that have been lodged against decisions of the Borough Council.

RESOLVED that:-

i.        the report be received; and

ii.        progress with current appeals and recent appeal decisions be noted.
