The Committee considered:-

In accordance with the Council’s Public Speaking Scheme Mr J Stentiford (Agent) spoke in support of this application and the following Reserved Matters  Application at Item 5.

i.          a reserved matters application for a multiplex cinema, multi-storey car park, associated commercial units and residential apartments in relation to the development approved in outline under reference 15/01305/OL, for Benchmark Leisure Limited; and

ii.         a report of the Planning Services Manager (Reference 16/199) attached.

The Committee considered:-

i.          To consider a reserved matters application for a multiplex cinema, multi-storey car park, associated commercial units and residential apartments in relation to the development approved in outline under reference 15/01305/OL, for Benchmark Leisure Limited; and

ii.         a report of the Planning Services Manager (Reference PSM/16/199).

Updating the report the Planning Officer reported that the two kiosks at the entrance to Northstead Manor Gardens were part of the public realm.  One of the kiosks had been refurbished and would most likely be incorporated on to the site and the other kiosk may be dismantled.  The Planning Officer suggested adding a condition to clarify what would happen to the kiosks and if necessary incorporate the Tourist Information Centre kiosk into the site.

Members sought clarification on whether the mounds were to be grassed, the trees being lost from the site, the entrance to the flats, disabled access route,  flooding issues from both the sea and overtopping of Peasholm Park, car parking, the potential conflict from queuing Open Air Theatre-goers and access to the cinema and when leaving a performance, parking and traffic management.

The Planning Officer advised that the mounds were to be grassed, replacement trees were covered by condition as was enhancing the biodiversity of the area.  The Environment Agency’s recommendations had been incorporated into the scheme to mitigate against flooding issues.  Disabled access, parking and traffic management were largely outside the remit of this reserved matters application, but Planning Officers were aware of these issues and demonstrated the disabled access route at the meeting.  Further consultation would be taking place between the relevant parties as necessary.  Regarding potential conflict between theatre-goers and cinema customers, this had been taken into account by insisting on a minimum area of public realm.

RESOLVED that permission be GRANTED subject to the conditions set out in the report and the addition of a condition regarding the potential incorporation of the TIC kiosk within the site.

i.          an application for approval of reserved matters consent relating to outline permission 09/00717/OL for post-phase 1 phases of mixed-use development, comprising 325 dwellings, including 27 live/work units, employment and office buildings, community hall, drainage basins, open space, play facilities, landscaping and associated infrastructure, for Provincial Land Developments Ltd; and

ii.         a report of the Planning Services Manager (Reference 16/226) attached.

The Committee considered:-

i.   a application for approval of reserved matters consent relating to outline permission 09/00717/OL for post-phase 1 phases of mixed-use development, comprising 323 dwellings, including 27 live/work units, employment and office buildings, community hall, drainage basins, open space, play facilities, landscaping and associated infrastructure, for Provincial Land Developments Ltd; and

ii.  a report of the Planning Services Manager (Reference PSM/16/226).

Updating the report the Planning Officer reported that the following had been received:-

a)        a revised plan showing the layout of affordable housing, which had been reduced to 30% in line with Council policy;

b)        revised plans for the bridge design (received the day prior to the Committee meeting).  The Planning Officer reported that further consultation was necessary with the Highways Authority.

c)         a revised schedule of play equipment, to be incorporated into a condition to include the standard of the play equipment;and

d)        the comments of the SBC Drainage Engineers, who has no objections to the scheme.

In paragraph 7.4 of the report text had been omitted regarding the NPPF restrictions on the Town Centre Impact Assessment.  Planning Officers have no concerns regarding this and was not considered to be a conflict.

The Planning Officer recommended that the application be approved subject to the summarised conditions set out in the report, a variation to the S106 Agreement to reduce the affordable housing requirement and trigger payments and that delegated authority be given to Planning Officers, in consultation with the Chair and Vice-Chair, regarding the assessment of the new bridge designs, the S106 Agreement and full details of the conditions.

Members raised concerns regarding lack of rear access to properties which would affect bin and cycle storage.  The Planning Officer suggested that there could be a condition that where there was no provision for bin and cycle storage that some form of rear access was provided.

RESOLVED that Reserved Matters permission be GRANTED together with the recommendations of the Planning Officer as outlined above.
