CElection of Chairman

To elect a Chairman for this meeting.


RESOLVED that Councillor Neil Price be elected as Chairman for this meeting.

Exclusion of the Public

To consider the following motion:-

"whether under Section 100A(4) of the Local Government Act 1972, the public should be excluded from the meeting for the following item(s) of business on the ground(s) that it/they involve(s) the likely disclosure of exempt information (as defined in Part 1 of Schedule 12A of the Act).  Any such decision is subject to a public interest test as provided by paragraph 10 of Schedule 12A of the Act.”



There was no application for the exclusion of the public and based on the content of the papers there is no reason to exclude the public.

To consider a report by the Environment and Regulation Manager (Report 19/054 attached).  This report seeks the determination by the Licensing Sub-Committee of an application for the grant of a premises licence where one or more relevant representations has been received.



The Licensing Sub-Committee considered a report by the Environment and Regulation Manager (Report No 19/054).


(i)            Written representations received from Mr and Mrs Patrick Monkman.


RESOLVED that the Licence be granted for the following activities





Hours granted


Supply of alcohol  (for consumption both on and off the premises)

Mon to Sun 10.30 – 22.30

Hours open to public

Mon to Sun 08:00 – 23:00


The licence will be subject to the following conditions:


1.            The premises shall operate as a restaurant/ bistro / cafe and not as a bar or vertical drinking establishment.


2.            There shall be a minimum number of 20 covers at all times the premises is open to the public.


3.            No alcoholic drinks for consumption on the premises shall be taken to outside areas including land owned by the premises, the pavement or the highway.


4.            Signage shall be placed on the premises stating that no open  drinks can be taken outside.


5.            Any kegs used for the provision of alcohol shall be incorporated within a self-contained portable bar unit and there shall be no more than two varieties of alcoholic drink available for service from the unit (max 2 kegs).




6.            The following CCTV conditions shall apply:


i)          A colour digital CCTV system shall be operational at the premises at all times when licensable activities are being carried out and at any other times where members of the public are present on the premises.


ii)         The CCTV system shall contain the correct time and date stamp information.


iii)        The CCTV system shall cover all areas of the premises occupied by the public under the terms of the licence.   


iv)        The CCTV system shall be capable of providing quality images of good evidential value. The CCTV system shall have sufficient storage retention capacity for a minimum of 28 days’ continuous footage.


v)         The CCTV footage shall be controlled and kept in a secure environment to prevent tampering or unauthorised viewing.


vi)        The Data Controller, under the Data Protection Act 1998, who is responsible for any CCTV images captured on cameras on the premises, shall, on the lawful request of an authorised officer or an officer of North Yorkshire Police, cause any required footage to be downloaded immediately or, where this is not possible, as soon as reasonably practicable and supplied to the requesting officer. Where the CCTV images are not supplied at the time of the request being made, the Data Controller shall ensure that they are secured to prevent any overwriting.


vii)       The CCTV system shall be adequately maintained and be capable of transporting recorded material onto a removable media. The CCTV system replay software shall allow an authorised officer or an officer of North Yorkshire Police to search the picture footage effectively and see all the information contained in the picture footage for the purposes of detecting, investigating and preventing crime. It shall be possible to replay exported files immediately e.g. no indexing of files or verification checks.
