RESOLVED that Councillor Roxanne Murphy be appointed as Chair.

Exclusion of the Public

To consider the following motion:-

"whether under Section 100A(4) of the Local Government Act 1972, the public should be excluded from the meeting for the following item(s) of business on the ground(s) that it/they involve(s) the likely disclosure of exempt information (as defined in Part 1 of Schedule 12A of the Act).  Any such decision is subject to a public interest test as provided by paragraph 10 of Schedule 12A of the Act.”

 

Minutes:

There was no application for the exclusion of the public.

APPLICATION FOR GRANT OF A PREMISES LICENCE - SNEATON CASTLE CENTRE, CASTLE ROAD, WHITBY, YO21 3QN pdf icon PDF 99 KB

To consider a report by the Environment and Regulation Manager (report 19/190 attached).

 

This report seeks the determination by the Licensing Sub-Committee of an application for the grant of a premises licence where one or more relevant representations has been received.

 

Minutes:

The Licensing Sub Committee considered a report by the Environment and Regulation Manager (report 19/190). 

 

The Sub Committee had the benefit of a report of the Environment and Regulation Manager, the Application, an Applicant’s bundle containing a letter from the Sisters of the Holy Paraclete, Extracts from a Sale Agreement, an Acoustic Report and Event Management Plan together with other supporting documents submitted by the Applicant and copies of each representation from the Interested Parties.

 

The Sub Committee heard from the Applicants representatives and the Interested Parties.

 

Following consideration of all matters before them the Sub Committee

 

RESOLVED: The licence be granted in accordance with the application as amended by the Sub Committee and with the following additional condition added to those already volunteered by the applicant and appearing in the operating schedule.

 

With specific reference to the Plan contained at Appendix M Page 95 of the Event Management Plan submitted by the Applicant for the Area marked S3 and the Area marked S4 the following will apply;

 

‘There will be no Regulated Entertainment permitted at any time within the  Area S3 or Area S4 as shown by blue edging and crosshatching on the Premises Plan.

 

Licensable Activities for Area S3 and Area S4 will cease at 23:30 hours Monday to Sunday with the premises being open to the public from 07:00hours to 00:00 (midnight) Monday to Sunday.

 

With regard to these conditions the Applicant is directed to supply a revised Premises Plan clearly showing Area S3 and Area S4 as outlined at Appendix M, page 95 of the submitted Event Management Plan, by blue edging and cross-hatching, to the Licensing Authority for the approval of the Chair of the Sub-Committee in conjunction with the Licensing Officer.

 

Volunteered Condition 4 will be amended as follows

 

4.   Prominent, clear and legible notices shall be displayed at all exits and specifically including all final exists from the Licenced Premises  requesting the public to respect the needs of local residents and to leave the premises and the area quickly and quietly.

 

Volunteered Conditions will be added as follows;

 

The Premises Licence Holder must comply with the Events Management Plan submitted by the Applicant Version V.2.0 dated 6th November 2019.’

In addition the following words will be added to that condition;

 

The submitted Events Management Plan Version V.2.0 dated 6th November 2019 will not be amended or altered without the prior approval of the Licensing Authority.

 

‘A direct telephone number for the duty manager must be prominently displayed where it can be conveniently read from the exterior of the premises by the public.  The telephone must be manned at all times the premises is open for licensable activities.’

 

‘Lighting at the Licensed Premise when Licensed Activities are taking place will be used and managed in such a way as to not cause nuisance or disturbance to residents surrounding the Licensed Premise.’
