Minutes:

Cllr David Jeffels declared a personal and non-prejudicial interest in agenda item 11 (Response to North York Moors National Park Authority) as he was a representative of North Yorkshire County Council on the Park Authority.

 

Cllr Subash Sharma also declared a personal and non-prejudicial interest in agenda item 11 (Response to North York Moors National Park Authority) as he was a representative of Scarborough Borough Council on the Authority.

PLANNING APPLICATION 19/00713/RG3 - FILEY FLOOD ALLEVIATION SCHEME pdf icon PDF 1 MB

To consider a planning application for construction of flood defences, comprising of a series of earth embankments to encircle large areas of the town of Filey; flood water storage areas; land raising; and drainage channels and culverts to redirect floodwater flows (report of the Planning Services Manager ref 19/130 attached). The Committee considered:

ii. a report of the Planning Services Manager (Reference 19/130).

 

The Planning Officer provided a summary of the detailed report and clarified that the existing access to Muston Mill would not be utilised but a new access created to the South of Filey School.

 

As local Ward members, Cllr Sam Cross spoke in objection to the application and Cllr Mike Cockerill spoke in favour of the application.

 

The Planning Officer clarified that funding matters relating to the application were outside the remit of the Committee

The Planning Officer provided a summary of the detailed report.

 

Members were informed that the local parish council had requested that the hedgerow on the eastern approach be maintained and cycling safety and public rights of way be considered.

 

Under the Council’s Public Speaking Scheme, Carl Stott (agent) spoke in favour of the application. As a local Ward member, Cllr Heather Phillips spoke in objection to the application.

 

Members considered the application and report.

 

Some concerns were raised on design aspects of the proposal and that the relevant locality had significantly changed in the last three years including reduced transport infrastructure. There was some concern that the proposed development was not sustainable.

 

Clarification was requested on the impact of traffic movements, adjacent to the site. It was proposed and seconded that the item be deferred until the traffic movements and other information could be clarified further. This was put to the vote and not carried. It was noted that the site had been assessed by the Inspector presiding over the Local Plan Examination-in-public and endorsed for allocation and that with regard to the application, the Highways Authority as statutory consultee had not raised any objections.

 

RESOLVED that permission be GRANTED subject to the conditions set out in the report.

The Committee considered a report of the Planning Services Manager (Reference 19/95) in respect of current appeals which had been lodged against decisions of the Council. There were no updates to the report.

RESPONSE OF THE BOROUGH COUNCIL ON THE NORTH YORK MOORS NATIONAL PARK AUTHORITY LOCAL PLAN (PRE-SUBMISSION DRAFT) pdf icon PDF 249 KB

To consider a report by the Planning Services Manager (ref 19/112 attached).

 

Minutes:

The Committee considered a report of the Planning Services Manager (Reference 19/112) in respect of a proposed response for the Council to the North York Moors National Park Authority’s Local Plan which was at pre-submission stage.

 

Members were informed that local planning authorities were expected to co-operate and work in partnership. Members were reminded that in planning terms part of the Borough came under the National Park Authority’s jurisdiction.

 

The draft Plan was on the whole welcome but officers highlighted concern that a specific policy concerning ‘tranquillity’ was somewhat vague and open to misinterpretation such as to mean most proposed development would not be permitted. Whilst the Park Authority had a duty to protect and enhance the Park environment, there still needed to be appropriate balanced development to ensure that the Moors and residents lived in a modern live world.

 

Member endorsed the proposed response to the Plan, including expressing concerns with regards to the wording of the policy relating to tranquillity.

 

RESOLVED that the contents of the North York Moors National Park Pre-Submission Local Plan be noted and that the proposed response from the Council be endorsed supporting the documents in relation to their legal compliance, soundness and the duty to co-operate.
