Updating the report the Planning Officer provided further information regarding the development, including an indicative location of the proposed pedestrian-cycle bridge to Newby. In accordance with the Council’s public speaking scheme, the agent, Jonathan Dunbavin spoke in support of this, and the following, application. Concerns were raised relating to the delivery of the bridge, specifically that the threshold of the number of homes by which the bridge had to be built would not be reached. Officers assured the Committee that the bridge was an integral part of the development and that this and the following application on the agenda would secure its construction.

 

RESOLVED that permission be GRANTED subject to the conditions and the Section 106 obligations set out in the report.

Updating the report the Planning Officer advised that the section 106 contribution towards the doctors surgery amount to £67,991.00, higher than the figure stated in the report. Further, that morning the applicant had queried three conditions within the report:

 

·         Condition 23: The timing of the delivery of the new bus stop – the Planning Officer proposed that the timing could be discussed further with the applicant and officers be given delegated authority to finalise the condition.

·         Condition 15: Measures to enhance biodiversity – the Planning Officer advised that this was an essential condition.

·         Condition 9: Groundworks relating to the pumping station – the Planning Officer proposed that landscaping details be discussed further with the applicant and officers be given delegated authority to finalise the condition.

 

Concerns were raised about the poor state of the listed building, including an old mill, on site. Officers informed the Committee that they were hopeful that a scheme to redevelop and secure the future of the listed buildings would come forward in the near future. Concerns were also raised regarding the size of rooms, specifically third bedrooms, in the houses on site. Officers advised the Committee that they were seeking to address the issue of room size through the Local Plan Review, through which they sought to implement (currently discretionary) national minimum standards.

 

RESOLVED that permission be GRANTED subject to the conditions and the Section 106 obligations as set out in the report, and as amended at the meeting.

Having been briefed by Planning Officers regarding this item, and while appreciative of the demand for houses of multiple occupation (HMOs) in the town, members described North Marine Road as a key area for small hotels and guesthouses, and were concerned about the proliferation of HMOs in that area. Additionally, members voiced concerns about the risk that the maximum number of occupants in the property be exceeded. Officers reassured the Committee that enforcement action by both Planning and Environmental Health services would ensure that any such issue would be swiftly rectified.

 

RESOLVED that permission be GRANTED subject to the conditions set out in the report.

9.

Removal of Telephone Kiosks pdf icon PDF 392 KB

The Committee considered a report by the Planning Services Manager (reference 20/12).

 

Updating the report the Planning Officer informed the Committee that since the publication of the report two additional comments had been received:

 

·         In regards to the phone kiosk in Cayton, a member of the parish council there had notified Officers of its use in an emergency in the area, and suggested its retention.

·         Whitby Town Council had notified Officers of their objection to the removal of the kiosk near Royal Crescent, in the town, due to its proximity to the seafront, and the fact that it had been used 178 times within a year.

 

In response to the first comment, local ward councillor and member of the committee, Councillor Roberta Swiers advised that the kiosk at Cayton had only been used four times within a year, but in that same year had been vandalised twice. Taking a vote on whether to keep or remove the two aforementioned kiosks the Committee voted in favour of keeping the Whitby kiosk, and removing the Cayton kiosk.

 

RESOLVED:

 

      i.        that Table 1 of this report be the basis for publishing the ‘First Notification’; the initial response on the removal of eight phone kiosks across the Borough, amended to include the retention of the kiosk on Whitby’s Royal Crescent, which the Committee voted to retain.

 

    ii.        that due to the time restrictions in providing a ‘Final Notification’ Officers be given delegated authority to reply to BT, taking into account any further comments on the removal of phone kiosks, following at least one month from the publication of the ‘First Notification’.

 

REASONS:

 

      i.        The reasons for the proposed objection to certain phone kiosks are set out in the report and based on the responses from Town and Parish Councils and the local community.

 

     ii.        The reason that delegated authority is sought for the ‘Final Notification’ is to ensure a response is sent to BT within the timescales set.
